Terms and Conditions of Jaew Wallet Service

Terms and Conditions of Jaew Wallet Service (hereinafter referred to as “Conditions of Service”) is the agreement made between PaySbuy Co., Ltd. (hereinafter referred to as the “Service Provider” as one part, and the “User” as another part for the use of Jaew Wallet Application services (or any other name as amended by the Service Provider) in connection with the money transfer, request money, money top-up and any transaction to be further prescribed, amended or modified by the Service Provider (hereinafter referred to as “Jaew Wallet Service”) via mobile, internet network or any other electronic system as prescribed by the Service Provider. The User agrees to be bound by and comply with the Conditions of Service.

  1. General Terms
    1. The User agrees to be bound by and comply with the Conditions of Service, including other terms and conditions in relation to the provision of services under Jaew Wallet Service provided by the Service Provider in all respects (either currently prescribed or to be prescribed by the Service Provider in the future) which shall be deemed an integral part of the Conditions of Service.
    2. The User has completely read and understood the details of the Conditions of Services and agrees to use Jaew Wallet Service by means of electronic method via mobile, internet network or any other electronic system prescribed by the Service Provider.
  2. Registration and Log In for use of Jaew Wallet Service
    1. Registration for Use of Jaew Wallet Service
      1. Procedures for applying Jaew Wallet Service for new user (no e-wallet with the Service Provider)
        The User shall download Jaew Wallet Application for installation of e-wallet provided by the Service Provider in the name of Jaew Wallet (or any other name as amended by the Service Provider) via mobile (or other electronic device to be prescribed by the Service Provider) and completely provide personal information of the User as specified in this clause.
        • name-surname;
        • identification card number;
        • email address;
        • mobile number (regardless of any mobile network) whereby the User can use only 1 (one) mobile number for applying Jaew Wallet Service;
        • OTP (One Time Password) which is received from the Service Provider in the form of SMS (Short Message Service); and
        • set 6 digits of numeric PIN (alphabet letters or words are not allowed) to be used as personal identification of the User in Log In process and execute any transaction via Jaew Wallet Service, including for confirming that the User is a person executing electronic transaction himself or provide electronic signature for such electronic transaction.

        In this case, the User is able to amend PIN in accordance with the conditions and procedures prescribed by the Service Provider.

      2. Procedures for applying Jaew Wallet Service for the User having Paysbuy Wallet (or any other name as amended by the Service Provider)
        ผู้ใช้บริการต้องดาวน์โหลดแอพพลิเคชั่น JThe User shall download Jaew Wallet Application for installation of e-wallet provided by the Service Provider in the name of Jaew Wallet (or any other name as amended by the Service Provider) on mobile (or other electronic device to be prescribed by the Service Provider) and click “for first time of PaySbuy’s User, click here” and provide personal information as specified in this clause which is the information the User provided for applying Paysbuy Wallet (or other name as amended by the Service Provider):
        • email address;
        • password (8-16 digits);
        • mobile number (regardless of any mobile network) whereby the User can use only 1 (one) mobile number for applying Jaew Wallet Service;
        • OTP (One Time Password) received from the Service Provider in the form of SMS (Short Message Service); and
        • set 6 digits of numeric PIN (alphabet letters or words are not allowed) to be used as personal identification of the User in Log In process and execute any transaction via Jaew Wallet Service, including for confirming that the User is a person executing electronic transaction himself or provide electronic signature for such electronic transaction.

        In this case, the User is able to amend PIN in accordance with the conditions and procedures prescribed by the Service Provider.

      3. The User acknowledges and agrees that the User is not entitled to amend or modify certain personal information used for applying Jaew Wallet Service i.e. identification card number, mobile number and email address.
    2. Log In for Use of Jaew Wallet Service
      Once the User has completely applied for use of Jaew Wallet Service in accordance with the conditions and procedures prescribed by the Service Provider, the User will be able to log in for use of Jaew Wallet Service in accordance with the conditions and procedures specified by the Service Provider as follows:
      1. In the case where the User logs in with Jaew Wallet account (or any other name as amended by the Service Provider), the User shall provide personal information as follows:
        • mobile number (regardless of any mobile network) whereby the User can use only 1 (one) mobile number for applying Jaew Wallet Service; and
        • 6 digits PIN which has been set in accordance with conditions prescribed by the Service Provider.
      2. In the case where the User logs in with Paysbuy Wallet (or any other name as amended by the Service Provider), the User shall provide personal information as follows:
        For the log in for first time use of Jaew Wallet Service, the User shall provide his/her personal information used for applying Paysbuy Wallet (or any other name as amended by the Service Provider) as follows:
        • email address; and
        • password (8-16 digits).

        For the subsequent log in for use of Jaew Wallet Service, the User can provide the personal information as specified in section 2.2.1.

      3. In respect of the conditions and procedures for log in for use of Jaew Wallet Service, the User can log in via mobile (or other electronic device to be prescribed by the Service Provider) for 1 (one) mobile for each time of use only. If the User does not carry out any transaction within 10 (ten) minutes after completion of log in, the system will automatically log out and the User will then need to re-log in to the system.
  3. PIN or Password for Applying Jaew Wallet Service
    1. The User shall keep PIN or Password confidential and not disclose to any person. The User acknowledges and agrees that if there is any transaction executed via Jaew Wallet Service with the use of PIN or Password of the User (either by the User or any person allowed by the User to use PIN or Password of the User), intentionally or negligently, it shall be deemed that such transaction is completed and binds the User as if it was done by the User in all respects. If there is any damage incurred by the use of PIN or Password of the User in accordance with the conditions of this section, the User agrees to be liable for such damage in all respects. The User is not entitled to object or claim against the Service Provider for any damages.
    2. Once the User has completely executed any transaction through Jaew Wallet Service, the User acknowledges and agrees that such transaction cannot be terminated, revoked, amended or modified. The User agrees to be bound by such transaction in all respects. The Service Provider shall not be liable for damage incurred by execution of any transaction under the User’s account with the use of such PIN or Password.
    3. In the case where the User forgets PIN, the User shall click “Forgot PIN” and provide mobile number and identification card number used for applying Jaew Wallet Service and 8 digits confirmation code received via email address to unlock and set up new PIN (6 digits). In this case, the Service Provider reserves the right to change conditions and procedures for setting up new PIN in the event that the User forgets PIN at any time as the Service Provider deems appropriate. The User acknowledges and agrees that such procedures will not affect any transaction executed prior to notifying the Service Provider.
      If the User forgot Password, the User shall access website www.paysbuy.com and click “Forgot Password” and comply with the conditions and procedures prescribed by the Service Provider.
    4. The Service Provider shall suspend Jaew Wallet Service automatically if the User provides incorrect PIN via Jaew Wallet Service more than the times specified by the Service Provider (currently, not exceeding 3 times). In this case, the User can unlock by contacting Jaew Call Center, Telephone No. 02-202-8222 to unlock. The Service Provide may, at any time, add, amend or modify the conditions and procedures for setting up PIN.
  4. Scope of Jaew Wallet Service
    The User can use the following Jaew Wallet Service in accordance with conditions and procedures prescribed by the Service Provider:
    • Top-up money to Jaew Wallet;
    • Receive and transfer money between Jaew Wallet and/or P2P from Jaew Wallet to e-wallet of the recipient in the name of mPAY and/or Wallet by True Money;
    • Transfer money to the transferee who has not applied for Jaew Wallet Service;
    • Request Money;
    • Top-up airtime for mobile networks i.e. Happy and Truemove/Truemove H+; and
    • Top-up money to Apple Id or iTunes Account with iTunes Gift Card or top-up money into Google Account or Google Wallet with Google Play Gift Card.
  5. Inspection of Information in Using Jaew Wallet Service The User can inspect the information in using service at the history of transaction under Jaew Wallet Application or contact Jaew Call Center, Telephone No. 02-202-8222 requesting for inspection of details of transactions executed in the past in accordance with the details and conditions prescribed by the Service Provider.
    If the User requests the Service Provider to deliver details of transactions to the User, the Service Provide will deliver such information to the User’s email address provided at the time of applying for Jaew Wallet Service only.
  6. FeesThe User agrees to pay fees, service fees and/or any expenses in relation to the use of Jaew Wallet Service at the rates and pursuant to the conditions prescribed by the Service Provider (the details of current rates of fees, service fees and/or any expenses in relation to the use of Jaew Wallet Service appear on the schedule attached hereto), including fees, service fees and/or any expenses to be prescribed, amended or modified by the Service Provider as the Service Provider deems appropriate.
    The User acknowledges and agrees that the User shall pay the fees, service fees and/or any expenses for depositing money via automated teller machine (ATM), payment point or any channel prescribed by the Service Provider for topping up money into Jaew Wallet, money transfer and any transaction via Jaew Wallet at the rates and pursuant to the conditions specified by the relevant banks and/or payment points (the details of current rates of fees, service fees and/or any expenses in relation to the use of Jaew Wallet Service appear on the schedule attached hereto), including fees, service fees and any expenses of airtime and/or connecting to internet for use of Jaew Wallet Application at the rates and pursuant to the conditions specified by the relevant mobile operator and/or internet operator. The User shall check the details with the relevant banks, mobile operator or internet operator.
  7. Conditions for Use of Jaew Wallet Service
    1. The User can use Jaew Wallet Service only via mobile of any network (or other electronic device to be prescribed by the Service Provider) through internet network. The Service Provider is entitled to add, amend or modify channel or network that the User can use Jaew Wallet Service as the Service Provider deems appropriate.
    2. The User acknowledges and agrees to accept risks and/or damage incurred or to be incurred by the use of Jaew Wallet Service on mobile (or other electronic device prescribed by the Service Provider), including the delay, failure, loss, forgery or amendment of transaction, information or document which may occur during the time or after the transaction, information or documents has been sent from or reached to the User. Such case shall not be deemed as the Service Provider’s failure and the Service Provider shall not be liable for the failure, impairment or insecurity of mobile (or other electronic devices to be prescribed by the Service Provider) or PIN, Password or any information used for executing the transaction in whatsoever reasons. The Service Provider shall not be liable for any failure or damage arising from or in connection with any of the following actions:
      1. the information is adapted, modified or done with any action on mobile (or other electronic devices prescribed by the Service Provider) of the User which would create risks to the use of services by the User, such as jailbreak, unlock, root Android, installation of applications from unknown sources etc.;
      2. the information in relation to the User or use of Jaew Wallet Service under the Conditions of Service is disclosed to any person via channel or other procedures in addition to the disclosure specified under the Conditions of Service;
      3. there is linkage of website (Hyperlink) and/or installation of any operational system from system or any channel which is not the system or channel prescribed by the Service Provider;
      4. the User does not give cooperation or does not allow the Service Provider to inspect or investigate suspicious circumstance; and
      5. the User does not comply with or fails to comply with the Conditions of Service and/or terms and conditions for use of electronic service and/or other terms in relation to the use of Jaew Wallet Service of the Service Provider.
    3. The User acknowledges and agrees that the Service Provider has provided this service for the purpose of facilitating the User of Jaew Wallet Service only and the User agrees that:
      1. the Service Provider does not involve with the supply and/or presentation and/or sale and/or delivery of goods or service and the Service Provider shall not be liable for the supply and/or delivery and/or defects of goods or services in whatsoever reasons;
      2. it is the duties and responsibilities of the User to inspect name-surname and/or mobile number and/or any information in relation to the money transfer or accepting the money transfer or any transaction via Jaew Wallet Service before executing each transaction on Jaew Wallet;
      3. In the event that there is any failure, defects, delay and/or damage arising from the process of accepting/delivering information via mobile of the mobile operator (or other electronic devices prescribed by the Service Provider) of the Service Provider or mobile network operator or internet network operator, the User agrees that the Service Provider shall not be liable for any damage; and
      4. the Service Provider is entitled to, at any time, ignore, suspend or terminate Jaew Wallet Service (either in whole or in part) as the Service Provide deems appropriate without notifying the User.
    4. The User agrees and consents the Service Provider to keep the information of the User, including information relating to the use of services of the User in the computer system of the Service Provider and to disclose the User’s information, such as name-surname, mobile number and other information to (a) third party as necessary for the use or providing services under Jaew Wallet Service, and (b) the other Jaew Wallet Service users as the User has specified names in the contact list in Jaew Wallet Application pursuant to the conditions prescribed by the Service Provider.
    5. In the case where the Service Provider finds that the User’s account has executed any suspicious transaction, the Service Provider reserves the right to temporarily suspend the services for inspection of the User’s transactions.
    6. The User acknowledges and agrees that the Service Provider is the electronic payment service provider having the obligations to report suspicious transaction to the Anti-Money Laundering Office by which the User is obliged to provide personal identity by registering and providing evidence as prescribed by the Anti-Money Launder Act B.E. 2542. If the User does not register or provide evidence within specified period, the Service Provider reserves the right to temporarily suspend the service provided to the User or carry out any other acts until the User has registered or provided evidence as prescribed by law or Anti-Money Laundering Office.
    7. The Service Provider will use its best efforts to provide services being satisfied to the User. Therefore, if any service is failed or delayed by computer system, internet system, electronic devices or any other systems in relation to the services hereunder, including mobile network and whatsoever reasons, the User shall not use such interference to claim against the Service Provider for any damages.
    8. The Service Provider shall not be liable for losses or damages, either directly or indirectly, arising from or in connection with the information stored in mobile or other electronic devices from the use of Jaew Wallet Service pursuant to the Conditions of Service.
  8. Representations and Warranties of the User
    1. The User acknowledges and agrees that the User shall be liable for financial results or any other results occurred or may occur from service used by the User or the User allows third party to use his/her personal information to apply for Jaew Wallet Service.
    2. The User represents and warrants that the User is the registered person of mobile number used for applying Jaew Wallet Service with the Service Provider.
      If the User is not the registered person of mobile number used for applying Jaew Wallet Service with the Service Provider, the User represents and warrants that he/she has obtained consent from the registered person of such mobile number to use for applying Jaew Wallet Service, and if there is any damage occurred, the User agrees to be solely liable for such damage.
    3. The User represents and warrants that the information provided for applying Jaew Wallet Service pursuant to the conditions and procedures specified in the Conditions of Service is complete, true and correct in all respects.
    4. The User represents and warrants that he/she shall not use this service for any financial transaction having the unlawful purpose, including gambling, prostitution, money laundering, any act being contrary to public order and good moral, infringement of intellectual property of other person or unlawful act under other laws. Therefore, if there is any damage incurred to the Service Provider or the Service Provider is claimed for any liability in connection with the financial transaction executed by the User for such purpose, the Service Provider is entitled to suspend or terminate the service immediately and the User shall be liable for damages to the Service Provider in all respects.
    5. The User represents and warrants that the information given to the Service Provider under the Conditions of Service is complete, true and accurate in all respects.
    6. The User agrees to strictly comply with and give cooperation to strictly comply with the laws, regulations, orders, notifications and conditions prescribed by the Bank of Thailand, Anti-Money Laundering Office, governmental authorities or any authority having the power to supervise Jaew Wallet Service (either currently prescribed or to be prescribed in the future). The User acknowledges and agrees that the Service Provider has, at any time, the right to amend any terms of the Conditions of Service to be in compliance with the relevant laws.
  9. Cancellation of Jaew Wallet Service by the User
    In the event that the User wishes to cancel the use of Jaew Wallet Service, the User can contact Jaew Call Center, Telephone No. 02-202-8222 so as to notify his/her intention to cancel Jaew Wallet Service and refund the balance maintained in Jaew Wallet. In such case, the User shall deliver copies of identification card and bank account for money transfer to the Service Provider specifying the contents prescribed by the Service Provider via his/her email address used for applying Jaew Wallet Service only for the purpose of personal identification. Then, the User shall send such information to jaewwalletsupport@paysbuy.com. The User acknowledges and agrees that the use of Jaew Wallet Service shall be terminated when the User has received a confirmation from the Service Provider. The Service Provider will refund money to the User (if there is any balance maintained in Jaew Wallet account in the amount not less than the amount prescribed by the Service Provider) after deducting any fees (if any). In such case, the Service Provider shall deposit money into the bank account notified by the User within the period specified by the Service Provider after the date on which the User has completely complied with the conditions and procedures prescribed by the Service Provider.
  10. Termination of Services
    1. The User agrees that Jaew Wallet Service will be immediately terminated if any of the following circumstances occur:
      1. if the User is taken a civil lawsuit, criminal lawsuit, bankruptcy lawsuit or there is order prescribed by governmental authorities to seize or attach assets of the User or the User is alleged or suspected as offender;
      2. If the User misrepresents in any provision specified in the Conditions of Service and/or the terms and condition in relation to Jaew Wallet Service;
      3. If the User fails to comply with any provision specified in the Conditions of Service and/or terms and conditions in relation to Jaew Wallet Service;
      4. If the Service Provider believes that the User is the offender or is trying to act any unlawful act or do any act that may incur damage to the Service Provider or any person or pursuant to any grounds specified by laws;
      5. the User is dead;
      6. it appears to the Service Provider that the User forges information, documents and/or takes one’s place wrongfully, either with or without consent, or provides untrue information for applying Jaew Wallet.

      The Service Provider reserves the rights to suspend or terminate the Jaew Wallet Service immediately and the User shall be liable for damages to the Service Provider in all respects, whether it is in good faith or bad faith.

    2. The Service Provider reserves the right to terminate Jaew Wallet Service by whatsoever reasons as the Service Provider deems appropriate.
  11. Consequence of Termination of Service
    If Jaew Wallet Service is terminated by whatsoever reasons and there is any balance amount maintained in Jaew Wallet account, the User can contact Jaew Call Center, Telephone No. 02-202-8222 for requesting such balance amount in Jaew Wallet (or other name as amended by the Service Provider) in accordance with conditions and procedures as specified in section 9 (Cancellation of Jaew Wallet Service by the User).
  12. Assignment of Rights and/or Obligations under Jaew Wallet Service
    The Service Provider reserves the right to assign any rights and/or obligations (either in whole or in part) under Jaew Wallet Service to any person which, as of the transfer date, may not affect the rights and obligations of the User without the User’s consent.
  13. Handbook and Relevant Documents in relation to Jaew Wallet Service
    The User acknowledges and agrees that all handbooks and documents in relation to Jaew Wallet Service, order, recommendation or acceptance via mobile which the User has complied with (either currently or arising in the future) are an integral part of the Conditions of Service.
  14. การยื่นข้อร้องเรียนการให้บริการ Jaew Wallet
    If the User would like to complain about Jaew Wallet Service, please contact Jaew Call Center, Telephone No. 02-202-8222 in which the Service Provider will inspect the complaints and inform the User of the progress, including explaining the procedures for solving problems for the Users within the period and procedures specified by the Service Provider.
  15. Governing Law
    The Conditions of Service shall be governed by and construed in accordance with the laws of the Kingdom of Thailand and the court of Thailand shall have exclusive jurisdiction to adjudicate any dispute arising under or in connection with the use of services under the Conditions of Service.
